Terms and Conditions of Use
These terms and conditions ("General Terms and Conditions of Sale") apply to the offering and sale of products through the Ryancosmesi.it website, which govern the sales contract between Ryan Cosmesi S.r.l., a multi-person company, and any individual who is eighteen years of age or older and purchases for strictly personal use, and presuppose the reading, knowledge, and acceptance thereof. Therefore, the Customer is required to carefully read these General Conditions before carrying out any transaction. They are intended to regulate the aforementioned purchases in accordance with the provisions of Legislative Decree no. 206/2005 ("Consumer Code"); furthermore, they may be subject to changes without notice, at any time, at the sole discretion of Ryan Cosmesi S.r.l. Their application coincides with the date of publication on the Ryan Cosmesi S.r.l. website. For matters not covered, reference is made to Articles 1490 et seq. of the Civil Code. The existing contract will be in Italian and will be governed by Italian laws.

3. Complaints
Any problem related to products already delivered, such as anomalies and/or malfunctions, can be reported to Ryan Cosmesi S.r.l., which uses such reports to constantly improve the service offered. 4. Conclusion of the contract
The presentation of products by Ryan Cosmesi S.r.l. on the e-commerce platform constitutes a mere invitation to offer, and not a public offer under Article 1336 of the Civil Code. The order transmitted by the Customer represents a contractual purchase proposal, subject to the approval of Ryan Cosmesi S.r.l. All products and their respective prices visible online are valid while stocks last and as long as they are published on the website. Ryan Cosmesi S.r.l. reserves the right to modify, update, or remove products from its online catalog at any time and without notice. The sales contract is considered concluded when Ryan Cosmesi S.r.l. sends the Customer, via the e-mail address provided during the purchase, a confirmation communication containing the order summary. This communication may follow an order placed either online or by phone, according to the specified procedures. Shipping costs, unless otherwise indicated, are not included in the price of the products and will be calculated and communicated separately during the purchase process, as specified in Article 9 of these conditions. For Customers qualifying as Professionals, a tax invoice will be issued, provided that the relevant request is made at the time of the order and a valid VAT number is provided.
5. Product unavailability
In the event that one or more products are temporarily unavailable, for any reason that prevents the order from being fulfilled due to unavailability, Ryan Cosmesi S.r.l. will promptly notify the Customer via e-mail, possibly proposing a partial shipment of the order or a replacement with equivalent items.
6. Prices
The selling prices of the products are expressed in Euro, inclusive of VAT and any other applicable taxes, and are valid exclusively within Italian territory. In case of regulatory changes related to tax rates, the relevant adjustment will be made. Ryan Cosmesi S.r.l. reserves the right to change product prices at any time and without prior notice. It is understood that the price reported on the website at the time the order is placed will be applied to the Customer, without any subsequent changes (either increases or decreases) having an effect on an already transmitted order.
7. Purchase and registration procedure
The Customer can freely browse the website without any purchase obligation. To make an online purchase on the Ryan Cosmesi S.r.l. website, the Customer has two options: register by creating their own account or proceed as an "anonymous Customer", in any case, indicating all the data required to finalize the order. In both cases, it is necessary to consult the privacy policy available on Ryancosmesi.it and provide the consents required for the use of personal data, where necessary. To correctly complete an order, the Customer must follow the following steps, according to the instructions provided:
• Select one or more products from the catalog and add them to the "Cart" using the "Buy" button;
• Indicate the desired quantity;
• Choose the delivery method;
• Fill out the appropriate form with shipping details;
• Accept the related costs;
• Choose the payment method from those available and enter the necessary data to complete the transaction.
The sales contract is considered concluded when Ryan Cosmesi S.r.l. sends the Customer a confirmation e-mail containing: the Customer's data, the order number, a summary of the purchased products, the total price, shipping costs, and the delivery address. Once a product is added to the cart, the displayed price remains valid until the order is completed. If the purchase procedure is not completed in a timely manner, the cart will be automatically emptied, and the previously displayed price will no longer be guaranteed. If, in the meantime, the online catalog undergoes price changes, the products still in the cart will also be updated. In this case, the system will notify the Customer of the change, showing the new price and offering the possibility to modify or remove the product from the cart. The same purchase procedure also applies to orders for products that Ryan Cosmesi S.r.l. makes available as a preview (the so-called "Product Launches"), which can be purchased in "Pre-order" mode. It is important to emphasize that the Pre-order does not imply an obligation for Ryan Cosmesi S.r.l. to deliver the product. For specific purchases, the online procedure may present some variations, which will in any case be explained in detail before finalizing the order. In the case of telephone purchases, the operator will illustrate the entire process, without prejudice to compliance with these general conditions.
8. Payment methods
Ryan Cosmesi S.r.l. offers the possibility to pay for products by credit card (Visa, Mastercard, Postepay, Amex, rechargeable cards) or PayPal. During the order completion phase, the Customer can choose to authorize Ryan Cosmesi S.r.l., or parties indicated by it, to securely save their credit card identifier on the payment provider's system, to facilitate any future purchases.
9. Product shipping times and costs
Orders will be processed exclusively if destined for locations within Italian territory and, exceptionally, the states of San Marino and Vatican City. Delivery times for orders placed online or by phone are, on average, 1-3 working days from the order confirmation by Ryan Cosmesi S.r.l.; however, for shipments to islands, delivery may take 3-4 working days. If the purchase order contains fresh masks, delivery may take longer. The Seller will do everything in its power to meet these deadlines. Orders are prepared only on working days (Monday to Friday, excluding holidays). Orders placed on Saturday and Sunday will be processed on the next working day. Shipping will be carried out by express courier to the address provided by the Customer at the time of the order. Any requests for delivery at specific times will be communicated to the courier, but compliance cannot be guaranteed. To ensure timely and problem-free delivery, the Customer is required to provide a mobile number in the shipping details. Upon delivery, the Customer must carefully check that the package is intact, well-sealed, and free from signs of damage. Every shipment is closed and sealed: if it is damaged or tampered with, it could indicate an unauthorized attempt to open it. In such a case, the Customer must immediately report the anomaly to the courier, accepting the package with a specific reservation, clearly indicating the type and location of the damage found. In the absence of this report, the goods will be considered delivered correctly. Upon receipt, it is recommended to immediately verify that the received products are complete and correspond to the order placed. Any irregularities or problems must be promptly communicated to the Seller by writing to the e-mail address: servizioclienti@ryancosmesi.it. The delivery terms indicated above are purely indicative and do not constitute a binding commitment. Consequently, Ryan Cosmesi S.r.l. cannot be held responsible for any delays compared to these deadlines. However, it is guaranteed, in compliance with Article 61 of the Consumer Code, that the order will be processed within a maximum of 30 (thirty) days from the contract confirmation date. Shipping costs are:
• For orders up to €49.99: €8.00
• For orders from €50.00: free shipping
10. Product Information
The images of the products on the Ryancosmesi.it website are for illustrative purposes only; they are included to visually present the items for sale, but may not perfectly reflect the actual characteristics of the product. Differences in color, size, or proportions may occur, also due to the settings of the device or browser used. In any case, in the presence of discrepancies between the image and the textual description, the information provided in the product description sheet always prevails.
11. Right of withdrawal
Pursuant to and for the purposes of Legislative Decree no. 206 of 06/09/2005, as amended by Legislative Decree no. 21/2014, the Consumer is entitled to exercise the right of withdrawal, i.e., to withdraw from the contract without any penalty and without specifying the reason, within 14 (fourteen) calendar days from the date of delivery of the purchased goods. To exercise the right of withdrawal, the Consumer must submit, within 14 (fourteen) days, a request for return by accessing their personal area, to which they must attach: a copy of the purchase receipt and the item code purchased. This communication can be sent by e-mail to the following address: servizioclienti@ryancosmesi.it. In any case, the Customer undertakes to return the products without delay, however, within 14 (fourteen) days from the date on which they communicated their intention to withdraw. Ryan Cosmesi S.r.l. reserves the right to check the condition of the returned products and their packaging. If the products are damaged, altered, used, or otherwise not compliant with correct and intended use, the company may not authorize the refund. Once the integrity of the returned products has been confirmed, Ryan Cosmesi S.r.l. will refund the Customer the amount paid for the items subject to withdrawal, including shipping costs incurred at the time of purchase. The refund will be made as soon as possible and in any case within 14 (fourteen) days from the receipt of the withdrawal communication. In line with the provisions of Article 56, paragraph 3 of Legislative Decree 206/2005, the refund may be suspended until the products are received by the Seller.
12. Effects of withdrawal
In the event of withdrawal by the Customer, payments made by the Customer to Ryan Cosmesi S.r.l. will be reimbursed; conversely, the Customer must provide Ryan Cosmesi S.r.l. with the bank details (IBAN) necessary for the refund. The return shipment must be organized directly by the Customer, who is responsible for the related costs. The products must be shipped to the following address: Ryan Cosmesi S.r.l., Via Marigliano 123/A, 80049, Somma Vesuviana (NA). The goods must be intact, sealed, and unused; otherwise, for hygiene and health protection reasons, no refund will be provided.
13. Consumer rights regarding product conformity and guarantees
According to Article 130 of the Consumer Code, if the purchased product has a lack of conformity, the Customer has the right to have the product repaired or replaced, without any additional cost. This right can be exercised within 2 (two) years from the date of delivery of the product, provided that the defect is reported to Ryan Cosmesi S.r.l. within 2 (two) months of discovery. To correctly manage the request, the product must be returned intact, in its original packaging, and complete with the fiscal documentation received. Only in this way can we guarantee rapid and effective assistance and restore the product to the advertised conditions. It should be noted that the warranty does not cover damages caused by incorrect use of the products, damages caused by carriers, and damages caused by third parties, but only those attributable to conformity defects of the products.
14. Personal Data Protection
The personal data provided by the Customer at the time of the order will be processed by Ryan Cosmesi S.r.l. exclusively to finalize the purchase and manage every phase of the transaction, in full compliance with current regulations on personal data protection, both Italian and European, and as indicated in the Privacy Policy available on the Ryancosmesi.it website. Ryan Cosmesi S.r.l. guarantees maximum security in data management: in the case of online payment, no data related to the payment method used by the Customer is stored or displayed in any way. This information remains confidential and accessible exclusively to the entity responsible for managing electronic payments, solely for the purpose of completing the collection operation. By submitting the order, the Customer declares that the data provided is true, correct, and updated. For more details on the processing of personal data, please consult the Privacy and Cookie Policy section of the official Ryancosmesi.it website, where all information is available in a transparent and accessible manner.
15. Intellectual Property Rights
All content on the website, including but not limited to: videos, tools, fonts, images, sounds, texts, menus, colors, schemes, designs, music, photos, logos and distinctive signs, features, software, methodologies, processes, diagrams, and layouts are the exclusive property of Ryan Cosmesi S.r.l. Any use, even partial, of such content is prohibited without the prior written authorization of Ryan Cosmesi S.r.l., which exclusively holds all rights thereto.
16. Liability
Ryan Cosmesi S.r.l. undertakes to guarantee the best possible service, but cannot be held responsible for delays or disruptions caused by force majeure events or unforeseen circumstances beyond its control. These include, by way of example but not limited to: provisions or restrictions imposed by governmental authorities, states of war, terrorist acts, strikes, protests, civil unrest, fires, natural disasters, epidemics, embargoes, extreme weather conditions, blackouts, interruptions or malfunctions of the Internet or telephone network, website overloads, traffic blocks, public or private transport strikes, and any other situation that may prevent the correct execution of the service. In such circumstances, Ryan Cosmesi S.r.l. will in any case do everything possible to mitigate inconvenience and guarantee compliance with its commitments to the Customer, compatibly with the situation.
17. Entirety
These General Conditions of Sale are to be understood in their entirety as a unitary and inseparable set of clauses. Should one or more provisions prove to be invalid, null, or ineffective under current legislation, this will in no way compromise the validity and effectiveness of the remaining clauses, which will continue to have full value.
18. Applicable Law, Competent Court, and alternative dispute resolution
These general conditions of sale are governed by Italian law. For Customers who fall within the definition of "Consumer", the provisions of Legislative Decree 206/2005 (Consumer Code) on distance contracts and Legislative Decree 70/2003 on electronic commerce apply. For any dispute arising from the interpretation or execution of the contract, territorial jurisdiction will be exclusively attributed to the Court of Naples, without prejudice to the mandatory jurisdiction of the court of the place of residence or domicile of the Consumer, as provided for by the Consumer Code. Pursuant to Articles 140 and 141 of the Consumer Code, the Consumer has the right to:
• Refer to a consumer association for the protection of their interests;
• Promote an attempt at out-of-court settlement of the dispute.
From January 9, 2016, in accordance with EU Regulation no. 524/2013, the Consumer can also access the European Online Dispute Resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr. Through this platform, the Customer can:
• Consult the list of alternative dispute resolution (ADR) bodies;
• Access the websites of the ADR bodies;
• File a complaint to initiate an online dispute resolution procedure related to a contract concluded online.
In any case, the Consumer's right to resort to ordinary jurisdiction remains unaffected, regardless of the outcome of the alternative settlement procedure.
